Relocation

If the company you work for moves location, for whatever the reason, you, the employee have certain rights and obligations.

Employees’ rights

When the company you are working for moves location your situation in the first instance will depend on your contract of employment. Where there is a mobility clause this normally means your employer can force you to relocate – within reason. If you don’t have a mobility clause in your contract, and the relocation is more than a short distance, you can decide not to move. In this case, your employer may make you redundant

Relocation when the company has been taken over

Your rights are protected under regulations known as TUPE – Transfer of Undertakings (Protection of Employment) – under which all of your existing rights, including contractual rights and redundancy protection, are unchanged. It makes no difference that it’s a new owner that introduces the relocation.
